CRIMINAL FACTION IN THE DECISIONS OF THE SUPREME FEDERAL COURT

Abstract

The expression criminal faction is used by the media, public security agencies, by criminals, by academy and legal operators. The paper is based on Discourse Analysis of Decisions of Supreme Federal Court – STF and interpreted the Court's uses of the expression.  It was observed that the criminal faction is applied as a social collective dedicated to crime, replacing the expression criminal organization. Criminal faction appears, almost always, to support the dispositive parts of Decisions based on the ideology of social defense.

Mestre em Segurança ´Pública, Justiça e Cidadania. Possui graduação em Engenharia Civil pela Universidade Católica do Salvador (1986), graduação em Bacharelado Em Direito pela Universidade Católica do Salvador (1994) e graduação em Licenciatura Em Matemática pela Universidade Católica do Salvador (1986). Atualmente é Delegado de Policia Civil Estado da Bahia.
