IMPACTO NA PREDISPOSIÇÃO PROFISSIONAL NA POLÍCIA MILITAR QUANTO AO USO DA FORÇA

Abstract

The custody hearing began to be implemented throughout Brazil after its regulation through Resolution No. 213/2015 of the National Council of Justice. In Santa Catarina, this procedure was implemented in September 2015 in Florianópolis, later extending to the main districts of the State. Since then, the custody hearing has been the subject of complaints by the state police since, in practice, several repeat offenders have been released and a significant increase in the investigative procedure to investigate state police conduct has been released. The discussion about the subject is of paramount importance in the academic environment and its improvement is essential. The present work was based on the use of force and its historical origin, as well as to identify the origin of the custody audience in Brazil and its objective within the Cultural War idealized by Antônio Gramsci and Hebert Marcuse. A questionnaire was applied to the State Police of 1ºBPM - Itajaí, identifying the reflexes of custody hearing in the morale of troops and the professional predisposition to the use of force in state police occurrence.
